                           SURAT DIREKTUR JENDERAL PAJAK
                       NOMOR S - 1205/PJ.341/2006

                             TENTANG

              PAJAK PENGHASILAN PASAL 26 ATAS GUARANTEE FEE

                        DIREKTUR JENDERAL PAJAK,

Sehubungan dengan surat Saudara tanggal 17 November 2006, bersama ini kami sampaikan hal-hal sebagai 
berikut :
1.  Surat Saudara tersebut pada intinya mengemukakan hal-hal sebagai berikut :
    i.  Saudara menerima tagihan/invoice guarantee fee dari parent company yang berkedudukan
        di Thailand atas jaminan yang diberikannya atas hutang PT TPCIPC kepada BST dan BBJ.
    ii. Saudara menanyakan apakah guarantee fee tersebut merupakan obyek PPh Pasal 26 
        berdasarkan Tax Treaty Indonesia-Thailand.

2.  Persetujuan Penghindaran Pajak Berganda (P3B) Indonesia-Thailand antara lain mengatur sebagai
    berikut :

    Pasal 7 ayat (1)
    The income or profits of an enterprise of a Contracting State shall be taxable only in that State Unless
    the enterprise carries on bussines in the other Contracting State through a permanent establishment
    situated therein. If the enterprise carries on business as aforesaid, the income or profits of the
    enterprise may be taxed in the other Contracting State but only so much of them as is attributable to
    (a) that permanent establishment; (b) sales in that other State of goods or merchandise of the
    same or similar kind as those sold through the permanent estalishment; or (c) other business activities
    carried on in that other State of the same or similar kind as those effected, through the permanent
    establishment.

    Pasal 11 ayat (1)
    Interest arising in a Contracting State and paid to a resident of the other Contracting State may be
    taxed in that other State.

    Pasal 11 ayat (2)
    However,
    a)  In the case of Indonesia, such interest arising in Indonesia may be taxed in Indonesia 
        according to the laws of Indonesia, but if the recipient is the beneficial owner of the interest,
        the tax so charged shall not exceed 15 percent of the gross amount of the interest;
    b)  In the case of Thailand, such interest arising in Thailand may be taxed in Thailand according
        to the laws of Thailand, but if the recipient is the beneficial owner of the interest, the tax so
        charged shall not exceed :
        (i) 10 Percent of the gross amount of the interest if it is received by any financial
            institution (including an insurance company);
        (ii)    In all other cases, 25 percent of the gross amount of the interest.

    Pasal 11 ayat (5)
    The term "interest" as used in this article means income from debt-claims of every kind,whether or
    not secured by a mortgage, and whether or not carrying a right to participate in the debtor's profits,
    and in particular, income from government securities and income from bonds or debentures,
    including premiums and prizes attaching to such securities, bonds or debentures, as well as income
    assimilated to income from money lent by the taxation law of the State in which the income arises
    including interest on deferred payment sales.

3.  Surat Edaran Direktur Jenderal Pajak Nomor SE-03/PJ.101/1996 tanggal 29 Maret 1996 tentang
    Penerapan Persetujuan Penghindaran Pajak Berganda (P3B) antara lain menegaskan hal-hal sebagai
    berikut :
    a.  Wajib Pajak luar negeri wajib menyerahkan asli Surat Keterangan Domisili kepada pihak yang
        berkedudukan di Indonesia yang membayar penghasilan dan menyampaikan fotokopi Surat
        Keterangan Domisili tersebut kepada Kepala Kantor Pelayanan (KPP) tempat pihak yang
        membayar penghasilan terdaftar.
    b.  Asli Surat Keterangan Domisili tersebut menjadi dasar bagi pihak yang membayar 
        penghasilan untuk menerapkan PPh Pasal 26 sesuai dengan yang ditegaskan dalam P3B yang
        berlaku antara Indonesia dengan negara tempat kedudukan (residence) dari Wajib Pajak luar
        negeri tersebut.

4.  Berdasarkan uraian dan ketentuan-ketentuan tersebut di atas, dengan ini diberikan penegasan 
    sebagai berikut :
    tegaskan :
    .   Guarantee fee sebagaimana disebutkan pada butir 1.i di atas tidak termasuk pengertian 
        "interest" sebagaimana diatur dalam P3B Indonesia-Thailand. Guarantee fee tersebut tunduk 
        pada ketentuan Pasal 7 P3B Indonesia-Thailand sehingga hanya dapat dikenakan Pajak
        di Indonesia apabila perusahaan di Thailand yang merupakan parent company PT TPCIPC
        tersebut melakukan kegiatan usahanya melalui suatu Bentuk Usaha Tetap di Indonesia.
    a.  Untuk dapat menerapkan ketentuan P3B Indonesia-Thailand, perusahaan induk (parent
        company) PT TPCIPC yang berkedudukan di Thailand dimaksud wajib menyerahkan asli
        Surat Keterangan Domisili kepada PT TPC Indo Plastic and Chemicals selaku pembayar 
        penghasilan dan menyampaikan fotokopinya kepada kepala KPP tempat PT TPC Indo Plastic
        and Chemicals terdaftar.
    b.  Apabila perusahaan induk PT TPC Indo Plastic and Chemicals yang berkedudukan di Thailand
        tidak dapat menyerahkan Surat Keterangan Domisili dimaksud, maka atas penghasilan 
        guarantee fee sebagaimana tersebut pada butir a dikenakan PPh Pasal 26 dengan tarif 20%.
