                           SURAT DIREKTUR JENDERAL PAJAK
                         NOMOR S - 08/PJ.341/2004

                            TENTANG

   KETENTUAN PERPAJAKAN ATAS BUNGA OBLIGASI PEMERINTAH BERDASARKAN P3B INDONESIA DENGAN 
                  BELANDA, PHILIPINA, SINGAPURA DAN INGGRIS

                        DIREKTUR JENDERAL PAJAK,

Sehubungan dengan surat Saudara Nomor Ref : XXX tanggal 9 April 2003, dengan ini disampaikan hal-hal 
sebagai berikut:

1.  Dalam surat Saudara disebutkan hal-hal berikut:
    a.  Dalam Persetujuan Penghindaran Pajak Berganda (P3B) Indonesia dengan beberapa negara 
        terdapat pasal tertentu yang menyatakan bahwa penghasilan bunga dibebaskan dari 
        pemotongan pajak. Negara dan Pasal tersebut antara lain sebagai berikut:
        -   Belanda     Pasal 10
        -   Philipina       Pasal 11
        -   Singapura   Pasal 11
        -   Inggris     Pasal 12

    b.  Untuk menghindari kesalahan pemotongan pajak bagi nasabah Saudara yang membeli 
        Government Bonds di Indonesia, Saudara memohon diberikan penjelasan atas:
        -   Tarif Pajak Penghasilan atas bunga Government Bonds Indonesia yang dimiliki oleh 
            penduduk dari negara-negara di atas;
        -   Tarif Pajak Penghasilan atas bunga Government Bonds Indonesia yang dimiliki oleh 
            Pemerintah negara-negara di atas.

2.  P3B Indonesia dengan negara-negara Belanda, Philipina, Singapura dan Inggris mengatur sebagai 
    berikut:
    a.  P3B Indonesia-Belanda Pasal 10:

        Ayat (2)
        However, such interest may also be taxed in the State in which it arises and according to the 
        ws of that State, but if the recipient is the beneficial owner of the interest the tax so charged 
        all not exceed 10% of the gross amount of the interest.

        Ayat (3)
        Notwithstanding the provisions of paragraph 2, interest arising in one of the two States shall 
        be taxable in the other State to the extent that such interest is derived by:
        (i) the Government of the other State, including political subdivision and local authorities 
            thereof;

    b.  P3B Indonesia-Philipina Pasal 11 ayat (3):
        Notwithstanding the provision of paragraph 2:
        (a) interest arising in a Contracting State and paid to a resident of the other Contracting 
            State shall be taxable only in that other State, if the interest in respect of:
            (i) a bond, debenture or aother similar obligation of the Government of that 
                State or a political subdivision or local autority thereof;

    c.  P3B Indonesia-Singapura Pasal 11 ayat (3):
        Notwithstanding the provision of paragraph 2, interest arising in a Contracting State and paid 
        to a resident of the other Contracting State shall be taxable only in that other State, if the 
        interest in respect of:
        (a) a bond, debenture or aother similar obligation of the Government of the first-
            mentioned State or a political subdivision or local autority thereof;

    d.  P3B Indonesia-Inggris Pasal 11:

        Ayat (2)
        However, such interest may also be taxed in the Contracting State in which it arises, and 
        according to the laws of that State; but where the beneficial owner of such interest is a 
        resident of the other Contracting State the tax so charged shall not exceed 10% of the gross 
        amount of the interest.

        Ayat (3)
        Notwithstanding the provisions of paragraph 2 of this Article, interest arising in a Contracting 
        State shall be exempt from tax in that State if:
        (a) it is derived and beneficially owned by the Government of the other Contracting 
            State, or a political subdivision or a local authority thereof, or the central bank of that 
            other State, or by any agency or instrumentality of, or any financial institution wholly 
            owned by, that Government.

3.  Berdasarkan ketentuan P3B tersebut di atas, dengan ini ditegaskan bahwa perlakuan perpajakan atas 
    bunga yang berasal dari obligasi Pemerintah Indonesia yang dimiliki oleh penduduk/Pemerintah 
    negara-negara Belanda, Philipina, Singapura, dan Inggris adalah seperti pada tabel berikut:
